Airport Section Volunteer Overtime Guidelines

1.               PURPOSE

 

The purpose of this section command memorandum is to establish procedures for the Atlanta Police Department Airport Section to utilize Voluntary Overtime. 

 

2.               POLICY 

2.1              It is the policy of the Atlanta Police Airport Section to utilize authorized voluntary overtime for reduction of crime, assist in the movement of pedestrian/vehicular traffic and to bolster law enforcement visibility during times of elevated Homeland Security alerts.  

2.2              Voluntary overtime will be in additional to the scheduled 160-hour work period and all hours worked on voluntary overtime will be paid whether or not an employee takes leave time during the 28-day work period.  Any leave taken during the work period will affect the number of hours paid at the overtime rate.  Employees working voluntary overtime will receive straight time for the total hours worked between 160 and 171.  In accordance with F.L.S.A. guidelines, actual hours worked over 171 during the 28-day work period will be compensated at the overtime (time and one-half) rate.  The Section Commander must authorize compensatory time in lieu of voluntary overtime pay. 

3.               RESPONSIBILITIES

 

3.1              It is the responsibility of each Watch Commander to assign employees to their respective work assignments. 

3.2              It is the responsibility of each Watch Commander to answer questions and resolve any concerns related to voluntary overtime issues.  If questions or conflicts cannot be resolved at this level, the Section Commander will resolve them. 

3.3              It is the responsibility of each Watch Commander to ensure that sergeants are available to supervise employees working voluntary overtime.  If there are no employees scheduled to work voluntary overtime on a given tour of duty, sergeants are authorized to work in a patrol capacity if slots are available. 

3.4              It is the responsibility of each Supervisor to enforce the guidelines established in this section command memorandum with employees in their respective chain of command.  

3.5              It is the responsibility of each employee to report to the on duty watch supervisor or the sergeant working voluntary overtime to receive an assignment and directions when reporting to work voluntary overtime                  

3.6              It is the responsibility of each employee to adhere to the stated guidelines.   

4.               ACTION 

4.1              Employees will only be allowed to work voluntary overtime in Class A or bicycle uniform with bicycle.  A plan of action must be submitted to the Section Commander detailing any need for plain-clothes employees to work voluntary overtime. The Section Commander prior to employees working voluntary overtime in plain clothes must approve the plan of action. 

4.2              Each watch commander will assess his/her watches need for voluntary overtime based on crime analysis/personnel shortages and will draft a weekly schedule.  Watch commanders must use discretion in assessing their needs, should the watch have sufficient on-duty officers or supervisors to accomplish all functions then voluntary overtime will not be scheduled. Officers will not be scheduled for voluntary overtime and allowed to just roam.  They must have a specific assignment. 

4.2.1           The weekly schedule will contain a location, time period to be filled and slots for sergeants and officers.  

4.2.2           The weekly schedule will be posted in a conspicuous place to allow officers to sign up for voluntary overtime.  

4.2.3           The original Weekly Voluntary Overtime Schedule and Airport Section Voluntary Overtime Time Sheet will be turned in to the Administrative Unit along with the Master Payroll Sheet bi-weekly.  These documents will be filed and maintained for 3 years.  

4.3              Sergeants working voluntary overtime will work as a patrolling supervisor, visible in the terminals, concourses and AGT.    

4.3.1           Sergeants working voluntary overtime will be allowed in the precinct for only brief periods to conduct business but the majority of his/her time must be as a patrolling supervisor. 

4.3.2           Sergeants working voluntary overtime will supervise officers working voluntary overtime and will assist on-duty supervisors in the supervision of on-duty officers. 

4.4              A supervisor, on-duty or working voluntary overtime, will contact radio and give specific assignments and radio numbers of units working voluntary overtime. Units working voluntary overtime will respond to calls for service. 

4.5              A supervisor, on-duty or one working voluntary overtime, will document on their work sheet the time and location they personally observed the officers on their assignments working voluntary overtime.  

4.6              Officers when reporting to work voluntary overtime will report to the on-duty supervisor or the sergeant working voluntary overtime for a briefing and inspection.  

4.6.1           Officers working voluntary overtime, upon completion of the briefing/inspection, will immediately report to his/her assigned position.  The parking of POVs or meal breaks will only be allowed at the discretion of the on duty supervisor or sergeant working voluntary overtime.  

4.6.2           Officers working voluntary overtime will only leave his/her assigned position when answering calls for service, responding to an emergency situation or when directed to do so by a supervisor. 

4.7              Employees will sign up for voluntary overtime in advance on the watch’s overtime schedule. Employees will put themselves on the schedule for the amount of hours needed to cover a specific assignment.  Visibility is a specific assignment.  Employees will not be allowed to work voluntary overtime unless they are on the weekly schedule.   

4.8              Day watch employees will be allowed to work voluntary overtime form 1500 to 1900 hours. Only two officers will be authorized to report at 0500 and no officers will be authorized to report at 0300.   This is the slowest time of the day for this facility. 

4.9              Evening and Morning watch employees will continue to work the hours prior to and after their regular assignment. 

4.10            The number of hours available to work voluntary overtime is at the discretion of the Section Commander.  Available hours will be based on the accomplishment of the public safety mission and available funds.  An employee cannot work more than a combined total of 130 hours on duty-scheduled employment for the Department and extra job employment in any two-week period.  The two-week pay periods are to correspond with Department pay periods.  The Field Operations Division Commander must approve any exceptions to these limitations in advance.  Voluntary overtime is on duty-scheduled employment. 

4.10.1         Sworn employees are prohibited from working any combination of scheduled on-duty and extra job employment for more than 16 hours in any 24-hour period. 

4.10.2         Sworn employees will be allowed to work one off day per week for a maximum of 8 hours toward their maximum.  Anyone working their off day will work on their assigned shift. However, if their Watch Commander has a need, they may work a 4-hour shift. 

4.10.3         Sworn employees assigned to in-service training or any other training will not be allowed to work voluntary overtime on the day of training. 

4.10.4         Sworn employees are not permitted to work voluntary overtime in conjunction with leave time, such as, vacation, sick leave, and compensatory time on the same day. 

4.10.5         Sworn employees cannot work voluntary overtime if they are assigned to any special detail away from their regular assignment. 

4.11            Traffic Control Inspectors will be allowed to work voluntary overtime as the need arises and at the discretion of the Section Commander. 

4.11.1         Traffic Control Inspectors assigned to the day watch must work after their assigned shift.  Traffic Control Inspectors assigned to the evening watch must work prior to their assigned shift.                  

4.11.2         Traffic Control Inspectors who take leave time during the workweek in which authorized overtime was worked, will be paid at straight time rate for those affected hours. 

4.11.3         Traffic Control Inspectors’ overtime will be prepared on a Departmental Overtime Use Report at the end of each 14-day pay period.  In addition, a memorandum to the Personnel Section will be attached to the Overtime Use Report.  The supervisor approving the overtime must sign this memorandum.  

4.12            The Voluntary Overtime Time Sheet will be completed, signed by the employee and the on duty watch supervisor or the voluntary overtime sergeant.  Any Voluntary Overtime form not properly completed or signed will result in that employee not receiving pay for the time worked. 

4.13            Voluntary Overtime Time Sheets are timekeeping documents and Departmental Rules and Regulations and policies will govern their use.  A copy of the Voluntary Overtime Time Sheet is attached. 

4.14            Approval to work voluntary overtime will be based upon the following criteria: employee’s job performance; employee’s productivity; complaints against the employee; abuse of sick leave; and any other factors that may adversely affect the employee or the Department. 

4.15            Employees privilege to work voluntary overtime may be revoked if the employee is found off an assigned position or late reporting to work for voluntary overtime.                 

4.16            These guidelines are subject to change as circumstances dictate.
