The intent of this directive is to establish a procedure in releasing seized items classified as evidence.
It is the policy of the Field Operations Division that the monthly “Evidence Release” reports are appropriately distributed and reviewed by officers for further disposition.
3.1 The Section Commander will monitor the status of evidence release within his/her command.
3.2 Each responsible officer will review the evidence release forms and indicate items to be released.
4.1 The Property Unit will compile a list of the aged evidence and place the items on the evidence release forms, which will be sent to the Section Commander with the responsible officer’s name and property to be released or maintained as evidence.
4.1.1 The Section Commander ensures through the Watch Commander that the responsible officer reviews the evidence release forms and indicates the items to be released.
4.1.2 The Responsible officer will sign the evidence release form and return it to the immediate supervisor within the time frame as prescribed by the Section Commander.
4.2 If the responsible officer is
absent for any reason (such as retired, resigned, terminated, leave of
absence, inactive status, or any other circumstance that causes the officer
to be absent for an extended period of time), the immediate supervisor will
fill out the information regarding the disposition of the items. 4.2.1 The immediate supervisor will then forward all signed forms from subordinates, through the chain of command, to the Section Commander.
4.3 The Section Commander or designee
will return the evidence release forms to the FOD Administrative Officer by
the 12th day of each month.
5.1 Evidence: Those items that have been seized and classified by an officer as evidence.
5.2 Aged Evidence: Those items held in property as evidence in excess of ninety (90) days.
5.3 Responsible Officer: The officer who confiscated and logged the items in question as evidence.
