Handcuffing Procedures

1.               PURPOSE

                 

To establish a procedure handcuffing an arrestee, detention of an arrestee and transportation of an arrestee.

 

2.               POLICY

 

It shall be the policy of the Atlanta Police Department, Zone Three Commander to ensure that arrestees are handcuffed and transported in an expeditious and safe manner to the arrestee and to the officers.

 

3.               RESPONSIBILITIES

 

3.1              All supervisors will ensure that sworn employees within their command comply with the requirements of this directive and provide assistance as necessary.

 

3.2              All employees will follow the requirements of this directive. 

 

4.               ACTION

 

4.1              Arrest Procedures

 

4.1.1           Employees will use only that force, which is reasonable and necessary to affect an arrest or restraint, and to ensure the safety of the arrestee, the officers and others.

 

4.1.2           Only restraining devices issued by the department and techniques authorized by the training unit will be utilized in the restraint, transportation, and detention of arrestees.

 

4.1.3           Handcuffs will be used whenever a suspect is physically arrested, both at the time of arrest, detention and transportation, regardless of the offense being charged.  Handcuffs and/or flexcuffs will be applied before a person is searched and should be double locked, with arrestees hands placed behind the back.  If needed officers can use flex cuffs or department approved ankle cuffs to secure feet.  Arrestees will remain handcuffed until placed in the custody of the appropriate detention facility personnel. 

 

4.1.4           Detention of arrestees, while in the custody of Zone Three all prisoners will be handcuffed and under constant supervisor by a sworn officer. 

 

1.    When no other suitable method of detention is available, detainees may be secured to an immovable object that is designed for such use. (CALEA 72.9.1c, 72.9.4) Examples include: a bench (fixed to the floor) with a bar or rings to which a handcuff may be secured; or a pole (fixed in the floor) with rings to which a handcuff may be secured.  

 

4.1.5           Transportation of arrestees.

 

1.    Prisoners that have be arrested on a City of Atlanta charges or a State charges will be handcuffed using steel handcuffs or flexcuffs while being transported to Grady Detention, City of Atlanta Jail or Fulton County Jail.

      

2.    Prisoners being transported in the wagon and/or patrol vehicle will remain handcuffed using steel handcuffs or flexcuffs until they are released to an officer within the proper detention facility.

 

4.1.6           Mentally Disturbed Prisoner

 

1.    Mentally disturbed person may pose a significant threat to themselves or others.  Officers must evaluate this potential and use restraining devices as needed, both to ensure custody and to provide for safe transportation or in conjunction with other restraining devices. 

 

2.    Special care should be used when choosing transportation for someone who is mentally disturbed.   When transporting a mentally disturbed prisoner, the arresting officer will act as the transporting officer.   If the mentally disturbed person is acting violent, the person should be transported in the wagon with handcuffs and flex cuffs and/or leg irons on the prisoners legs to prevent personal injury to themselves or to an officer or damage to the vehicles.  Mentally disturbed prisoners will be taken to Grady Detention for evaluation on the Psychiatric Emergency Clinic on the 13th floor.  If the mentally disturbed prisoner is seriously ill or injured have an ambulance transport them to Grady Detention, with one officer and the prisoner will be handcuffed to the ambulance bed rail.
