Retired Officer Firearms Qualification Program

1.               PURPOSE

 

To establish a policy for the Department’s authorization of the Retired Officer Firearms Qualification Program (ROFQP) in accordance with the provisions set forth in the Law Enforcement Officers Safety Act (LEOSA) of 2004.

 

2.               POLICY

 

The Atlanta Police Department will authorize and conduct a Retired Officer Firearms Qualification Program in accordance with the Law Enforcement Officers Safety Act.

 

3.               RESPONSIBILITIES

 

3.1             The Chief of Police is responsible for authorizing the implementation of the Law Enforcement Officers Safety Act through the retired officer firearms qualification program. 

 

3.2             The Academy Director is responsible for ensuring that the retired officer firearms qualification program complies with applicable federal and state guidelines and is implemented in a professional and safe manner. 

 

3.3             The Firing Range Master is responsible for providing and directly supervising the appropriate training necessary to conduct a retired officers’ firearms qualification program in accordance with the Law Enforcement Officers Safety Act and issuing and maintaining the appropriate documentation. The Range Master will schedule a minimum of three separate training days throughout the calendar year to conduct the retired officers’ firearms qualification program.    

 

3.4             Former sworn Atlanta officers that participate in the retired officer firearms qualification program are responsible for ensuring that she or he meets the standards to participate in the program and complies with all aspects of the training program to include all of the Atlanta Police Firing Range rules.  Failure to fully comply with all of the conditions of the Atlanta Police Department’s retired officer firearms qualification program may result in the removal of the officer from the training and denial of future participation in the program at the discretion of the Training Academy Director.     

 

4.               ACTION

 

4.1             All retired sworn employees of the Department or sworn employees that separate from the Atlanta Police Department in good standing are authorized to participate in the Retired Officer Firearms Qualification Program, provided that she or he meets the requirements outlined in the Law Enforcement Officers Safety Act.

 

4.2             Retired sworn employees will only be certified by the Department to carry a firearm in accordance with the Law Enforcement Officers Safety Act after she or he has been trained by a Department certified firearms instructor and demonstrated proficiency to the Training Academy Section. 

 

4.3             Retired Officer Firearms Qualification Program Authorization Requirements

 

4.3.1          Authorized personnel participating in this program will be required to provide the following to the Training Academy Firing Range staff for verification purposes:

 

1.    His or her photographic Atlanta Police Department retired officer’s identification card.

 

2.    His or her certification from the State of Georgia, which   indicates that he or she meets the state standards.

 

4.4             Authorized personnel participating in the Qualified Retired Law Enforcement Officer program will be required to provide his or her own ammunition for use during practice, training, and qualification.   

 

4.5             Authorized personnel participating in this program may be allowed to practice twice a year at the range during an open firing range day, but must sign in with the firing range staff, bring their own ammunition, comply with all of the Firing Range rules and sign all appropriate waivers.

 

4.6             Authorized personnel participating in this program will be required to participate in classroom and firearms training and demonstrate proficiency with the type of firearm (revolver or semi-automatic) she or he desires to carry.

 

4.7             This program, at the Atlanta Police Firing Range, will not be open to officers from other agencies.

 

4.8             The Firearms Training Unit will issue documentation confirming that the retired employee has met the state standard and is qualified to carry a firearm in accordance with the Law Enforcement Officers Safety Act of 2004.

 

4.9             The Firearms Training Unit Range Master will distribute Form APD 284 (Continued Suitability for Employment Consent Form) to all authorized personnel participating in the Qualified Retired Law Enforcement Officer program. Subsequent to the collection of Form APD 284, the Firearms Training Unit Range Master, or his or her designee will collect Form 284 from the participants and forward the completed forms to the Office of Professional Standards within five business days of the participant’s firearms qualification date of completion.

 

5.               DEFINITIONS

 

5.1             Qualified Retired Law Enforcement Officer: The qualified retired law enforcement officer who meets the following seven requirements: retired in good standing from service with a public agency, other than for reason of mental instability; before such retirement, was authorized by law to engage in or supervise the prevention, detection, investigation, or prosecution of, or incarceration of any person for any violation of law and had statutory powers of arrest; before such retirement, was regularly employed as a law enforcement officer for an aggregate of 15 years or more, or retired from service due to a service connected disability; has non forfeitable right to benefits under the retirement plan of the agency; during the most recent 12 month period, has met, at the expense of the individual, the State’s standards for training and qualification for active duty law enforcement officers to carry firearms; is not under the influence of alcohol or another intoxicating or hallucinatory drug or substance; and is not prohibited by Federal law from receiving a firearm.

 

5.2             The Law Enforcement Officers Safety Act (LEOSA): The United States federal law, enacted in 2004, that allows two classes of persons—the "qualified law enforcement officer" and the "qualified retired law enforcement officer" -- to carry a concealed firearm in any jurisdiction in the United States, regardless of any state or local law to the contrary, with certain exceptions.
