Issuing Citations for Illegal

1.               PURPOSE

 

The purpose of this Section Command Memorandum is to establish procedures for officers to issue Uniform Traffic/Parking Citations for illegal parking at the airport.

 

2.               POLICY

 

It is the policy of the Atlanta Police Department Airport Section to issue parking citations to unattended vehicles found to be illegally parked and to allow an occupant of an illegally parked vehicle the opportunity to move the vehicle prior to issuance of a citation.

 

3.               RESPONSIBILITIES

 

3.1              It is the responsibility of watch supervisors to ensure the procedures established in this Section Command Memorandum are strictly adhered to.

 

3.2              It is the responsibility of field supervisors to respond to the scene of any incident involving illegal parking when an employee requests their presence. Radio transmission and/or Cell Phones will not be used to handle this type of incident.

 

4.               ACTION

 

4.1              Vehicles found unoccupied and illegally parked at the airport will be handled in accordance with written directives. If a vehicle is found to be unoccupied and illegally parked at the airport terminal roadside it will be immediately impounded due to security concerns.

 

4.2              Employees will notify occupants of illegally parked vehicles that the airport terminal side is restricted to immediate loading and unloading of passengers and baggage.  If there is a licensed driver in the vehicle, employees will allow the licensed driver sufficient time to move the vehicle. 

 

4.3              Should there not be a licensed driver or the occupants refuse to move the vehicle, employees will handle these incidents in accordance with written directives. 

 

4.4              When issuing a Uniform Traffic/Parking Citation to a driver for any violation where illegal parking was the cause and the driver profusely disagrees or becomes argumentative, the employee will call a police supervisor to the scene.  The employee will notify the driver that a police supervisor is en-route and the employee will calmly stand by keeping aware of his personal and public safety.

 

4.5              At no time will a parking citation and a Uniform Traffic Citation be issued to a driver for the same incidence of illegal parking.  If a Uniform Traffic Citation is issued to a driver and a parking citation has been issued for the same incidence of illegal parking, the officer will void the parking citation.

 

4.5.1           All airport police section employees will, when issuing a parking citation, use the city code section on the citation.                                               

 

4.6              All airport police section employees will, when issuing a parking citation to a violator, place the citation on the windshield of the vehicle in violation or give the parking citation to the driver of the vehicle in violation.  Under no circumstances will a citation be turned into traffic court when the issuing copy is not placed on the windshield or given to the driver.

 

4.7              In instances when an airport police section employee is unable to place the citation on the windshield of the vehicle or give it to the driver, the employee will call for a supervisor and the citation will be voided.
